  6. The TranScript software (including documentation) has been provided pursuant
  7. to a license agreement containing restrictions on its disclosure, duplication,
  8. and use.  The software contains proprietary information constituting valuable
  9. trade secrets of Adobe Systems Incorporated and is protected as an unpublished
  10. work by federal copyright law.  The software (or any portion thereof) may not be
  11. used for any purpose not contemplated by the license.  This notice must be
  12. embedded in or attached to all copies, including partial copies, of the
  13. software or any revisions thereof.

  35.            NOTICE TO GOVERNMENT END USERS
  36.  
  37. If the TranScript software is acquired by or on behalf of a unit or
  38. agency of the United States Government, this provision applies.  The
  39. TranScript software: (a) was developed at private expense, is existing computer
  40. software and no part of it was developed with government funds, (b) is a
  41. trade secret of Adobe for all purposes of the Freedom of Information Act,
  42. (c) is "restricted computer software" submitted with restricted rights in
  43. accordance with subparagraph (a) through (d) of the Commercial Computer
  44. Software - Restricted Rights clause at 52.227-19 and its successors and as
  45. expressly stated in Adobe's standard commercial agreement incorporated into
  46. the contract or P.O. between Adobe and the governmental entity, (d) in all
  47. respects is proprietary data belonging solely to Adobe Systems
  48. Incorporated, (e) is unpublished and all rights are reserved under the
  49. copyright laws of the United States.

  51. For units of the Department of Defense (DoD) the TranScript software is
  52. licensed only with the "Restricted Rights" as that term is defined in the
  53. DoD Supplement to the Federal Acquisition Regulations, 52.227-7013 (c)(1)(ii),
  54. Rights in Technical Data and Computer Software and its successors, and:
  55.  
  56. Use, duplication or disclosure by the Government is subject to restrictions
  57. as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
  58. Computer Software clause at 252.227-7013.

  62. If the TranScript software was acquired under a GSA Schedule, the Government
  63. has agreed to refrain from changing or removing any insignia or lettering
  64. from the TranScript software or the documentation that is provided or from
  65. producing copies of the manuals or media (except for backup purposes and
  66. in accordance with the terms of this agreement) and:
  67.  
  68.     (1) Title to and ownership of the TranScript software and documentation
  69.     and any reproduction thereof shall remain with Adobe Systems
  70.     Incorporated;
  71.     (2) Use of the TranScript software and documentation shall be limited to
  72.     the facility for which it was acquired; and
  73.     (3) If the use of the TranScript software is discontinued at the
  74.     installation specified in the purchase/delivery order and the
  75.     Government desires to use it at another location, it may do so
  76.     by giving prior written notice to Adobe Systems Incorporated,
  77.     specifying the type of equipment and the new location site.

  79. Government personnel using the TranScript software, other than under a
  80. DoD contract or GSA Schedule, are hereby on notice that use of the
  81. TranScript software is subject to restrictions that are the same as or
  82. similar to those specified above.
